A compliance checklist—requirements to consider
Consider these requirements when doing business in new states and hiring new employees.
- Fill out employee onboarding forms
- Report new hires to the state
- You must report new hires to the state where they work. The state uses this info to track debts (like child support).
- This report is usually due within 20 days of hire.
- Gusto can file a new hire report for you if you choose the option when adding an employee.
- Get Workers' Compensation Insurance
- Most states require this insurance, and Gusto can help. It covers employee injuries or illnesses on the job, providing benefits to employers and employees.
- You can get it through:
- A commercial carrier
- Your state’s insurance program
- Display required workplace posters
- You must post certain labor law posters in your workplace. Use the Department of Labor’s Poster Advisor to find what you need.
- Gusto offers a labor law poster subscription to make sure you remain compliant for both physical and remote locations.
- You can download free versions of posters or buy them online from other sellers like the Labor Law Poster Store.
- Follow labor laws
- Learn the employment laws that apply to your business, like:
- Minimum wage rules
- Wage garnishments
- Termination policies
- Contractor classification
- The Department of Labor’s Employer Guide has many of those details.
- The Small Business Administration also offers a 10-step guide for starting a business, which includes everything from writing a business plan to applying for licenses and permits.
- Learn the employment laws that apply to your business, like:
- Offer health insurance (optional)
- If you offer health insurance, follow ACA regulations.

- Handling pre-tax payroll deductions
